GENERAL CONDITIONS OF SALE
Any
order implies agreement to the present general conditions of sale. The
sale contract submits to English law. Orders can be placed only between
Nenuphar and a non-trading physical person.
The offer for sale of our products is subject to stock availability.
Although
we take great care in describing and presenting the articles sold as
precisely as possible, some errors might occur. In this case, we cannot
in any way be considered responsible.
The photographs showing the
articles have an indicative value only due to changes which may occur
during transcription on to the site.
Due to our purveyors, we may be
obliged to deliver an item whose manufacture may be slightly different
from the one described, but will always be in keeping with our quality
requirements. In this case and according to our "satisfaction
guaranteed" policy, you will be able to return the item for an
exchange.
Any transaction between Nenuphar and its customers not contested within 6 months cannot give rise to any claim.
Prices
Our prices are shown in Sterling. They are guaranteed except in the case of a typographical or printing error.
Prices do not include post and packing charges currently applied for delivery abroad (see "delivery").
For
some countries outside, import taxes may have to be paid to your
country's customs service according to the value of your parcel. Please
contact the Customs Dept of your country's postal service for further
information. All the prices given are VAT free as there is no VAT on
children clothes in England.
Acceptance of the offer and confirmation of the order by Nenuphar
The contract is concluded when the customer issues confirmation of his/her order.
Nenuphar sends an e-mail confirming your order within 3 working days.
You may also print out your order.
Deliveries
How quickly do you deliver ?
Delivery
time varies depending on the product and how it is shipped to you. Many
small or lightweight items are sent by first class post, and usually
arrive within two days. All overseas packages are sent by post, and
usually take 3-5 days for European countries, 7-10 days for North
America and 10-14 days for the rest of the world (depending on the
service used and your location).
How much does delivery cost ?
UK shipping costs vary depending on the items bought. Most orders have a shipping charges of £3.50.
Overseas delivery is subsidized and typically costs between £5.00 for Europe or £8.00 (depending on destination).
Can you ship overseas?
All our product can be shipped to almost anywhere in the world.
Can I choose whether to send my order to my home, my workplace or directly to someone else?
Direct
to your door, at a friend's or neighbour’s where you are staying on
holiday or at work... We will deliver your parcel to the address of
your choice, anywhere in the world. Simply state the delivery address
clearly on the order form or mention it when placing the order via the
Internet.
Gift wrapping/message
Nenuphar can
send gifts on your behalf: give the address of the person who is to
receive the gift and indicate weather you would like it gift-wrapped.
Add £100 per gift-wrap to the total amount of your order. If you wish
to send a gift to someone yourself, a gift-wrap can be enclosed with
your order, on request
It is free to include a message with your parcel if sending to someone else.
Returns
In
the event of an article not corresponding to our levels of quality, or
in the event of a damaged article, you must notify us immediately in
order that we may resolve the issue as swiftly as possible.
You have
30 days within which to reclaim or exchange on an article. The article
must be returned in its original state and packaging, accompanied with
the purchase receipt. Any incomplete, damaged, worn, or dirty returned
article will not be exchanged or refunded.

NB: All
references to "U.K." addresses below apply to England, Wales and parts
of Scotland only. "Days" means working weekdays and does not include
weekends and public holidays.
Security and Payment
Payment
for an order on line may be made by debit/credit card only. Please give
your card number (Visa, Eurocard, MasterCard) and the expiry date.
The
total cost of the articles dispatched (including post & packing)
will be directly charged to your account on the day of dispatch. Any
pending article will be debited only at the time of dispatch. If an
article is sold out, your account will only be debited for the items
dispatched.
To secure all payments, Nenuphar uses the secure software SSL.3.0
So
Nenupharlondon.com is a Secure Site hosted on a server using the latest
secure server software (SSL - Secure Sockets Layer). This means that
all sensitive information is entered in a protected part of the site
that no one else can view, and where all information travelling from
your computer to ours is encrypted (coded). When you enter the secure
section of our site (and of other Secure sites) you will either notice
a padlock (or key) image on the bottom of your browser window suddenly
appear, or see it change to a closed padlock (or unbroken key), to
indicate that that it is safe to enter sensitive information. You can
also see the start of the URL (internet address name) change from
"http" to "https" ("S" meaning "Secure"). When your card details are
sent for authorisation they are encrypted so that they cannot be read.
We use the same methods as used by many of the largest e-commerce sites.
In
all cases, supply on line of your debit/credit card number and final
validation of your order will, in accordance with the law on electronic
signature of 13 March 2000, be proof of integrity of the order and
payability of sums owed for the dispatch of the said order.
Intellectual property
All
elements of the Nenuphar website, be it visual or sound, including any
subjacent technology, are protected by copyright, trademarks or
patents. They are exclusively Nenuphar property.
Any user who has a
personal Internet site is able to put on his site a simple link which
gives direct access to the Nenuphar site homepage. This will in no way
imply an affiliation contract.
On the other hand, any hypertext link
using the framing technique or in-line linking to establish connection
to Nenuphar is strictly forbidden.
In any case, any link, even tacitly authorised, must be removed at Nenuphar’s request.
All elements on the Nenuphar website remain the exclusive property of Nenuphar unless otherwise stated.
No
reproductions, copies, or any elements of the website may be used,
distributed, or copied whether in full or partial, without prior
written acknowledgement of Nenuphar.
Nenuphar is wholly owner of all
the creative and design work as shown on this site, whether acquired by
purchase or whether designed/created within the company itself.
Dispute settlement
Nenuphar
cannot be held responsible for any inconvenience or damage emanating
from the use of the internet network, such as a supply cut, computer
virus or external intrusion.
